New E.U. regulation + compensation for me?

On the 17th new E.U. regulation goes into effect.

This is in 2 days.... I have a flight (not a charter) on the 21st... Waw-ams. And i just got called by the airline that it is cancelled.... (and i was rescheduled on a flight a day earlier) This ticket was booked half a year ago. Do the new compensation rules also apply for me (since the ticket was booked before the 17th... )


In the event of flight cancellation or denied boarding, the passengers concerned have the right to:

reimbursement of the cost of the ticket within seven days or a return flight to the first point of departure or re-routing to their final destination;
care (refreshments, meals, hotel accommodation, transport between the airport and place of accommodation, two free telephone calls, telex or fax messages, or e-mails);
compensation totalling:
- EUR 250 for all flights of 1500 kilometres or less;

- EUR 400 for all intra-Community flights of more than 1500 kilometres, and for all other flights between 1500 and 3500 kilometres;

- EUR 600 for all other flights.

Th second question is.... how do i enforce my rights... I asked them for compensation and they said they couldn't... should i just write a letter... or are the organisations to help me with this :)

think you'll find that even under the new regulations that as the airline has already informed you 'well' in advance you won't have a leg (or a seat ) to stand on. You should get a refund, but not anything extra.

if you look at the regulation
Article 5
Cancellation
1. In case of cancellation of a flight, the passengers concerned shall:
(a) be offered assistance by the operating air carrier in accordance with Article 8; and
(b) be offered assistance by the operating air carrier in accordance with Article 9(1)(a) and 9(2), as well as, in event of re-routing when the reasonably expected time of departure of the new flight is at least the day after the departure as it was planned for the cancelled flight, the assistance specified in Article 9(1)(b) and 9(1)(c); and
(c) have the right to compensation by the operating air carrier in accordance with Article 7, unless:(i) they are informed of the cancellation at least two weeks before the scheduled time of departure; or

so it all depend when they told you 2 weeks before or 13 days before !

The 21 of what month?
If it is FEBRUARY, the cancellation had to be given to you on 21 minus two weeks: that is before 07FEB. 06Feb was a Sunday.
So what was it?
What about your fare?
You are supposed to fly on FEB20? But you have booked and paid hotel from 20 to 21?
Did you plan something on FEB20?

I would not accept that rerouting. You claim it from the Ministry of Economical Affairs.
Keep all the documents, including the cover of your ticket, make photocopies, as the airline might want to take it, if they try you can refuse, as the cover shows the printing Passengers copy or coupon. Your baggages tag has to go with your copy.

It is the 21st of February i was supposed to fly, so i am informed less than a week in advance...


I could choose between flying on the 20th or the 22nd of february instead. Since I have obligations on the 22nd I had to choose for the 20th. They did not offer to reroute me on another flight of a different carrier, (KLM flies the same flight (waw-ams), but 20 minutes later)nor would i prefer this if it would mean i would lose my right for compensation.
When I asked the guy for compensation he said it was not possible, since I am in Poland at the moment and was roaming, i didn't want to get into it at that moment. (I did get a voucher for a free flight, just pay taxes, but they have this offer frequently)

@ SN30952: The fare paid was 25 euro's, including tax :oops:

And I am supposed to get it from the ministry of economic affairs... not the airline?? I will look into it tomorrow...

The airline is skyeurope and I didn't name them because generally I am very happy with them and fly with them frequently... however this time they screwed up.... They went to fly on different days of the week... when i looked at the timetable i think (but am not sure) this is the only flight which is affected

Correct.
Strange, because untill last week the timetable was still normal (monday-wednesday-friday - sunday). What could be the reason for this '1 week change' ? :?
