GOL aircraft collides with Embraer Legacy

ATC from Brasilia said Legacy Jet changed its route without authorization and ATC tried to inform Legacy Jet (without success) tha it would collide with Gol plane.
Questions :
Why communication was lost between ATC Brasilia and Legacy Jet ?
Why in case of no response from Legacy Jet, ATC did not get in touch with Gol plane to modify its course ?
How come that anti-collision system did not work ?
Gol plane was new. Received on Sept 12, had fly 200 hours.
Legacy Jet pilotes have been heard by ANAC and Infraeo, then moved to Cuiaba (capital of Matto Grosso) where Civil Police is hearing them.
There is no survivor.

Heu... I don't think this is the same accident and same aircraft. It is the tail of the Helios, boeing that crashed months ago in greece...LX-LGX wrote:here's a photo from the tail section of the plane:

According to Gazet van Antwerpen (www.gva.be), the Legacy was also brand new - and on it's delivery flight to Excel Air U.S.

It´s incredible that European press had given no importance to this accident envolving a brand new Gol low fare company 737-800 NG and an also brand new Legacy executive jet.
It´s the first NG accident, 155 passengers and crew dead and a wounded Legacy landed against all the expectations in a military base in the heart of Amazon rain forest.
More interesting, if not: Legacy pilot, an American who was ferrying the plane to Excel Aviation, in New Jersey, admited he had the transponder off and that he left the 360 flight level to 390 without authorization (Gol`s 737-800 was flying at 37 thousand feet). He had a Brazilian Embraer`s pilot next to him, Mr. Paladino, and only this can explaine how they could make the military runway in the middle of nothing at 4:48 pm.
Now we have to fight against the military residues in our Civil Aviation Department to find out what really happened. They didn`t released the pilot information and they announced that more details of the accident will come up only at the end of the investigation.
Brazilian Air Force closed all the airports, roads and rivers traffic near the crashsite (Amazon is considered priority area in terms of security because of drug traffic from Colombia) and didn`t release any information except on bodies rescue in the jungle. The Legacy is grounded at Cachimbo`s military base where they don`t alow journalists.
What we know about comes from american sites, maybe fed by a passenger of the Legacy, Joe Sharkey, who is a New York Times magazine columnist and had been invited for the flight to write a reporting for a corporative jet magazine.

In fact the Legacy pilots switched off the two transponders of the jet, moved from 36000 to 38000 feet to gain speed and time without prior authorization from ATC Brasilia or communcating whatsoever.
All passagers (Americans) and the two pilots are back to Sao Jose dos Campos (Embraer) as well as the two black boxes of the Legacy jet.
it seems that the Gol plane made a vertical fall at around 500 km/h, and there was no attemp to make a emergy landing.
Seeing the limited damages on the Legacy Jet, authorities cannot explain yet what happened with a much bigger plane (737-800).

Boeing collides...
The Rio de Janeiro newspaper O Globo says today that Gol aircraft has been authorized to cross from flight level 360 to 390. and did it in a kind of "radar shadow" area, a nobody land in State of Para where neither ATC in Brasília or control tower in Manaus can monitor. And more: American pilot of the Legacy said TCAS didn`t work, and he saw nothing, only a shadow and a shaken.
This is a picture of the Embraer who was involved in the accident.
It sounds strange that this aircraft has only"minor" damage and that the B737-800 - bigger and stronger - crashed.

Seeing the picture makes me wonder how the ERJ did hit the B737. It seems that besides the winglet there is not a lot of damage on the ERJ (some on horiz. tailplane and some on wing).
It's difficult for me to realize that such small contact area was able to destroy the B737.......

The two balckboxes from the Gol 737-800 have been found, but are very damaged.
The blackbox of voice recording is uncomplete . Missing the storage part.
The blaxkbox for data recording is complete.
Both should be sent to the US.
