Are we sure about the flight part of the story? I'm under the impression the aircraft returned to the gate before reaching the holding point.

Could explain for extra boring hours waiting in the airport, in the beer capital of the world, where beer is cheap especially when you come from the high North, having some "fun" with friends....But then again, all pure speculation, we'll probably never know the facts (nothing posted on YT so far )

They have been threated as a group, a group of drunk people.
But if they go to court, the judge will analyse it individual per individual I guess and good luck proving anything...

Nope. There is jurisprudence for such cases, by both Belgian courts and dispute/mediation commissions. The captain has the judicial right to refuse or offload passengers when he/she thinks that the flight safety is at risk. So it just depends on the declaration of the pilot to the police. When he/she told the police "I wanted to punish the whole group for their friends' behaviour", then it's denied boarding as per EU-Rule 261/2004. When he/she told the police "I estimated the risk too high that the same severe incidents might happen again during the flight with other members of the group, which would endanger the safety of all passengers", there is nothing the group can claim.
The press focusses on "41 passengers", but more important in this incident, legally, is that there was physical agression towards the crew.

ok, but one will say "yes, there was 41 polish people, and 40 were drunk. I'm number 41, i wasn't drunk, i did nothing"
maybe out of those 41, only one idiot did the assault (which is likely anyway).
Seems super touchy to me, there is no such thing as a group (unless their tickets are linked to each other ?), the same nationality doesn't make a group... and even then, being part of a group is no garantee you'll act the same way.
