Are we sure about the flight part of the story? I'm under the impression the aircraft returned to the gate before reaching the holding point.

Indeed. It happened during taxiing, Flemish tv VRT reports:

Indeed. The article has been corrected. (And VRT also reads us!)

There were no Belgians among the 41 unruly passengers, said Brussels Airlines. Where are they from?

ouch, now we are approaching the 'political correctness' borderline.... Well, actually depends on the answer anyway.
If it were Brits, well they are brexitting anyway, so in the future they'll probably fly BA ;) and we don't have to worry anymore.

No political correctness involved here. If they were not Belgian, they were probably in transit, and I just wanted to know from where their flight to Brussels was originating.

aaah, transiting passengers, never thought of that...
Could explain for extra boring hours waiting in the airport, in the beer capital of the world, where beer is cheap especially when you come from the high North, having some "fun" with friends....But then again, all pure speculation, we'll probably never know the facts (nothing posted on YT so far :) )

136 passengers for 144 seats means a load factor of 94,44 % Not too bad ! :-)

There are actually only 141 seat on the brussels airlines A319 so 96,45 load factor on this one.

According to VTM Nieuws, it was a group of Polish construction workers on their way to Alicante for a construction project.

Good luck proving them wrong and abusive ...
They have been threated as a group, a group of drunk people.
But if they go to court, the judge will analyse it individual per individual I guess and good luck proving anything...
It might be a costy case of SN

Nope. There is jurisprudence for such cases, by both Belgian courts and dispute/mediation commissions. They all regard it as a safety issue, both for the drunken passengers and also for their fellow travellers.

The captain has the judicial right to refuse or offload passengers when he/she thinks that the flight safety is at risk. So it just depends on the declaration of the pilot to the police. When he/she told the police "I wanted to punish the whole group for their friends' behaviour", then it's denied boarding as per EU-Rule 261/2004. When he/she told the police "I estimated the risk too high that the same severe incidents might happen again during the flight with other members of the group, which would endanger the safety of all passengers", there is nothing the group can claim.

The press focusses on "41 passengers", but more important in this incident, legally, is that there was physical agression towards the crew.

ok, but one will say "yes, there was 41 polish people, and 40 were drunk. I'm number 41, i wasn't drunk, i did nothing"
maybe out of those 41, only one idiot did the assault (which is likely anyway).
Seems super touchy to me, there is no such thing as a group (unless their tickets are linked to each other ?), the same nationality doesn't make a group... and even then, being part of a group is no garantee you'll act the same way.
Interesting case, anyway :)
